Preamble

This Refund and Cancellation Policy (hereinafter — the “Policy”) sets out clear rules for how You may cancel Your subscription to the Onmind.coach service — an online educational service for background learning of the English language, owned by English Club TV Ltd (hereinafter — the “Rightholder”) — and when a refund of amounts paid is possible. Onmind.coach is part of the Rightholder’s educational ecosystem, also represented at the partner website english-club.tv (https://english-club.tv). The Service is in a state of continuous development: the composition of subscription plans, individual features, methods of activation, and distribution channels may change; this Policy will be updated accordingly.

We strive to be transparent: no hidden traps, no “fine print” conditions. At the same time, we honestly note: this Policy is built on the “as is” principle — that is, by subscribing, You accept the conditions described herein in advance. If anything raises doubt in You, please first clarify it, then accept it as is, or decline to subscribe. Whatever is not expressly and obviously provided for by this Policy as a ground for a refund is by default not such a ground.

This Policy is an integral part of the Terms of Service and supplements its provisions.

Section I. General Principles

§ 1. The Foundations Everything Stands On

1.1. You can always leave. A subscription to Onmind.coach is neither a trap nor an addiction. You have the right to cancel it at any time, without unnecessary obstacles or explanations.

1.2. We do not hold anyone against their will. Cancellation of a subscription is carried out independently, with a few clicks, through the personal account on the website (or, if available, in the mobile application).

1.3. Access — until the end of the paid period. Cancellation of a subscription means that automatic renewal will no longer occur. However, until the end of the period already paid for, You retain full access to the Service — so that nothing You have paid for disappears without reason.

1.4. All payments — through Stripe. Technically, refund operations (where provided for by this Policy) are carried out through our payment partner — Stripe — with funds credited to the same payment card from which the charge was made.

§ 2. The Plans to Which This Policy Applies

2.1. The Service offers two subscription plans:

  • Monthly subscription — EUR 5 per month (or the equivalent in the User’s currency at the exchange rate effective at the moment of the charge). The charge takes place immediately upon subscription and thereafter every month on the same date.
  • Annual subscription — EUR 30 per year (or the equivalent in the User’s currency), with a 7-day free trial period. The trial becomes available only after a payment card has been linked to the account. Seven (7) calendar days after the start of the trial, the full annual amount — EUR 30 (or the equivalent) — is automatically charged to the linked card. Thereafter the subscription renews every year on the same date.

2.2. The Service may also contain individual features and materials available in free mode — this Policy does not apply to them (no charges or refunds are involved).

§ 3. Additional Fees and Costs

3.1. All additional payments above the base subscription cost are borne by the User independently. These include, in particular, currency-conversion fees, fees and interest charged by the issuing bank of the card, fees of the payment systems (Visa, Mastercard, etc.), fees of intermediary payment agents, as well as duties, customs charges, and taxes provided for by the legislation of the User’s country.

3.2. The amount of such additional payments is determined exclusively by the rules and tariffs of the banks, payment systems, and other organizations participating in the carrying out of the payment. The Rightholder does not control these tariffs and cannot influence them.

3.3. When a refund is made, only the base amount actually received by the Rightholder from Stripe is refunded (EUR 5 or EUR 30 in the corresponding currency of the charge). Additional fees withheld by banks, payment systems, and third parties during the original payment or during the refund operation are not refunded or compensated by the Rightholder.

3.4. Onmind.coach also bears no responsibility for differences in amounts arising from fluctuations in exchange rates between the moment of the charge and the moment of the refund.

Section II. How to Cancel a Subscription

§ 4. Step-by-Step Instruction

4.1. To cancel a subscription (whether monthly or annual, including during the trial), follow these steps:

  • 1. Log in to Your account on the Onmind.coach website (or, if a mobile application is available for Your platform, in the application).
  • 2. Go to the section “Personal Account” → “Subscription” (or the analogous subscription-management section).
  • 3. Click the “Cancel Subscription” button.
  • 4. Confirm Your intention in the pop-up window.
  • 5. Wait for the message confirming successful cancellation and, if You wish, save the corresponding confirmation that arrives by email.

4.2. From the moment of successful cancellation, the automatic charge for the next period will no longer occur.

4.3. Special note for subscriptions activated through application stores (in particular Apple App Store, Google Play, where such activation channels are currently available): if the subscription was activated through the corresponding application store, its cancellation is carried out directly in the settings of the application store. In such a case, refunds are also governed by the policy of the corresponding application store, and the Rightholder may not have the technical means to independently initiate cancellation or refund.

4.4. If something has gone wrong on a technical level, please contact our support service (contacts in Section VII). We will promptly help You complete the procedure manually.

§ 5. Timing of Cancellation

5.1. A subscription must be cancelled at least 24 (twenty-four) hours before the date of the next automatic charge. This time frame is sufficient for the Stripe payment system to process the cancellation and not initiate a charge for the next cycle.

5.2. If cancellation is carried out less than 24 hours before the scheduled charge, we do not guarantee that Stripe will technically have time to stop the transaction. In such a case, You will receive the paid period in full, after which the subscription will be terminated.

5.3. You can always see the date of the next charge in Your personal account in the subscription-management section.

Section III. Specifics of the 7-Day Annual Subscription Trial

§ 6. How the Trial Works

6.1. The trial becomes available only after a payment card has been linked to the account. This is a mandatory condition: without a linked card, free access is not activated.

6.2. By linking a card, You give Stripe an instruction in advance to automatically charge EUR 30 (or the equivalent in the User’s currency) on the day falling 7 (seven) calendar days after the moment of trial activation — unless You cancel the subscription independently before that moment.

6.3. Throughout all 7 days of the trial, You have full access to the Service — with no restrictions and no charges.

§ 7. How to Cancel During the Trial and Avoid the Charge

7.1. In order to avoid the automatic EUR 30 charge at the end of the trial, cancel the subscription at least 24 hours before the end of the seven-day period — in the manner described in § 4 of this Policy.

7.2. If You cancel the subscription during the trial, access to the Service is retained until the end of the seven-day period, after which it is automatically terminated, and no funds are charged.

7.3. If You do not cancel the subscription before the end of the trial, the automatic EUR 30 charge (or the equivalent in the User’s currency) is correct and lawful and, as a general rule, will not be refunded (see § 9 for details).

§ 8. The Trial’s Starting Point

8.1. The seven-day trial begins from the moment a payment card is successfully linked and the plan is activated. The exact date and time of the trial’s end, as well as the scheduled charge date, can always be seen in the personal account in the subscription-management section. We may also send You email reminders some time before the trial ends — but the ultimate responsibility for a timely decision lies with the User.

Section IV. Refunds

§ 9. The General Rule

9.1. As a general rule, funds for an already paid subscription period are not refunded. This applies both to the monthly subscription (EUR 5 per month) and to the annual one (EUR 30 per year), including the first charge after the end of the trial.

9.2. The reasoning behind this rule is simple: by subscribing, You immediately gain full access to the Service for the entire paid period. If You change Your mind in the middle of the period, You may of course cancel renewal, but funds for the unused days of the already paid period are not refunded.

9.3. This represents a fair balance between the freedom of the User and the Service’s ability to plan its operation and development.

§ 10. Exceptions: When Refunds Are Possible

10.1. A refund — full or partial — may be granted in the following cases:

  • Technical impossibility of use. If prolonged technical failures occurred on our side that made normal use of the Service impossible, and we were unable to remedy them within a reasonable period.
  • Erroneous or duplicate charge. If, for technical reasons, a duplicate or erroneous charge occurred, we refund the amount received in error in full.
  • A charge after a successfully made cancellation. If You cancelled the subscription in advance (at least 24 hours before the charge, including during the trial), but Stripe nevertheless effected the charge for technical reasons, we refund those funds.
  • Requirements of applicable law. In other cases where a refund is mandatory under the current legislation of Ukraine, the United Kingdom, or another applicable jurisdiction.

10.2. In all other cases not covered by § 10.1, the question of a refund is considered on an individual basis on the foundation of common sense, a goodwill approach, and regard for the specific circumstances. We do not provide any guarantees of refund beyond the list in § 10.1, but we promise to listen carefully to every inquiry.

10.3. Whatever is not expressly and obviously provided for by § 10.1 as a ground for a refund is by default not such a ground.

§ 11. Cases in Which a Refund Is NOT Made

11.1. A refund is categorically not made, in particular, in the following cases:

  • breach by the User of the Terms of Service — including prohibitions on hacking, non-standard methods of using the Service, unlawful activity, or violation of the intellectual property rights of English Club TV Ltd;
  • termination of access at the Rightholder’s initiative in connection with detected breaches;
  • the User’s personal change of mind without any objective grounds provided for in § 10.1;
  • non-use of the Service by the User during the paid period for reasons not attributable to the Rightholder (in particular, loss of interest, being busy, technical problems on the User’s side);
  • changes in the User’s personal circumstances not related to the quality of the Service.

§ 12. Procedure for Submitting a Refund Request

12.1. If Your situation falls under § 10.1 or You believe You have grounds for a refund, please send a message to the support service at customer.support@english-club.tv with the following data:

  • the email address registered to the Onmind.coach account;
  • the date and amount of the disputed charge;
  • a brief description of the situation;
  • (if available) screenshots or other supporting evidence.

12.2. We review the request within reasonable time frames (as a rule — within 10 business days) and notify You of the result.

12.3. In the case of a positive decision, funds are returned by Stripe to the same bank card from which the charge was made, in the amount of the base subscription cost actually received by the Rightholder. Technically, the refund may take from several days to several weeks — depending on the issuing bank of Your card. We have no technical means to accelerate this process on the bank’s side.

12.4. Onmind.coach bears no responsibility for refund delays caused by banks, payment systems, or other third parties, nor for any additional fees that may be withheld by them in the course of carrying out the refund.

Section V. Special Cases

§ 13. Price Changes

13.1. If we change the price of Your plan, we notify You in advance. If the new price does not suit You, You have the right to cancel the subscription before the next charge — without paying the new price.

13.2. If You have not cancelled the subscription by the time of the next charge at the new price, this means that You have accepted the new price.

§ 14. Termination of Access on Our Side

14.1. If we have restricted or terminated Your access to the Service in connection with Your breach of the Terms of Service — in particular in case of hacking, non-standard methods of use, violations of legislation, of intellectual property rights, or other actions prohibited by the Agreement — funds for the current paid period are not refunded. Moreover, the Rightholder retains the right to submit a separate claim to the User for compensation of damages caused, in the manner provided for by the Terms of Service and applicable law.

14.2. If termination of access has occurred not through Your fault but on our initiative and without objective grounds, we refund the unused portion of the paid period on a proportional basis.

§ 15. Gift Subscriptions and Promotional Codes

15.1. Subscriptions activated with promotional codes, promotional discounts, or as a gift are cancelled and refunded under the general conditions of this Policy, unless otherwise expressly stated in the terms of the specific promotion.

Section VI. Final Provisions

§ 16. Disputes and Dialogue

16.1. We are always ready to resolve any misunderstanding regarding cancellation or refund through dialogue. Please contact our support service — we treat every inquiry with attention.

16.2. If mutual understanding cannot be reached, the dispute is resolved in accordance with the current legislation of Ukraine and the United Kingdom (at the place of registration of the Rightholder), taking into account the norms of international law applicable to online services.

§ 17. Amendments to the Policy

17.1. We may update this Policy from time to time. The current edition is always available on the website with an indication of the update date.

17.2. By continuing to use the Service after an update, You confirm Your consent to the new edition.
